Eligibility
a)
|
Anyone aged 18 years and above can participate in the Art of Taste.
|
b)
|
For participant(s) under the age of 18, the participant must obtain consent from his/her parent or legal guardian to participate in the Art of Taste. Such participant may be required to show documentary evidence of such parental or legal guardian consent if so requested by HPB.
|

2.
|
Official Art of Taste Period
The Art of Taste wall at Dhoby Ghaut MRT will run from 8 Nov to 5 Dec 2024 while go.gov.sg/theartoftaste microsite will remain live till 19 Dec 2024.

3.
|
How to Participate
Participant(s) must:
|
Step 1: Scan the QR code at Dhoby Ghaut or visit go.gov.sg/theartoftaste.
Step 2: Enter their first name, choose their preferred dish and options presented and proceed to generate their own Art of Taste artwork.
Step 3: Choose to share their artwork on the large projector screen at Dhoby Ghaut, or on their social media platforms (Facebook, Instagram, TikTok) or save to their phones.
Step 4: When shared to the large projector screen at Dhoby Ghaut, the artwork may take some time to appear and will appear only once for 15 seconds.

Personal data
By participating in the Art of Taste, participant(s) consent to the collection, use, and disclosure of their data (e.g., first name) in accordance with the Personal Data Protection Act 2012 (PDPA). Data may be used by HPB for the following purposes: (i) publicity, advertising, or marketing of HPB’s programmes or initiatives, and (ii) identification in connection with the participant’s Art of Taste artwork. For more information, participants may refer to HPB’s data protection policy.

Intellectual Property
a)
|
HPB shall own the rights, title and interests including intellectual property rights in and to any work created through or in relation to their participation in the Art of Taste through any medium or form whether it be photography, videography or any other image recording means or technology (herein referred to as the “Image Recording”). Participants agree not to challenge HPB’s absolute rights to the Image Recording which may be used, amongst other things for publicity purposes in any manner HPB deems appropriate in their absolute and sole discretion (herein referred to as the “Promotional Materials”). Participants hereby irrevocably assign all present and future intellectual property rights in and to the Image Recording and Promotional Materials to HPB.

b)
|
Participants agree not to challenge HPB’s right to publish, reproduce, make adaptations, communicate and make available to the public, the Image Recording and the Promotion Materials in any media, whether in print, digital or any other format, for any publicity purposes connected with the Art of Taste or any other activity of HPB connected with being a participant in the Art of Taste (“Publicity Purposes”), including sharing or disclosing the Image Recording or the Promotion Materials to any other third party authorised by HPB for the Publicity Purposes, without restriction and without the need to notify the participant in advance.

c)
|
The participant will have no right to approve the finished product wherein the Image Recording appears and shall not receive royalties, or any other compensation arising or related to the use of the Image Recording or the Promotion Materials. The participant hereby waives any moral rights, including the right to be identified as the author or to object to derogatory treatment of the Image Recording or Promotional Materials, to the fullest extent permitted by law.

d)
|
There shall be no time limit, nor is there any limitation in geography or medium on the use of the Image Recording or the Promotion Materials set out in Clauses 5a to 5c above.
|
e)
|
The participant hereby releases, waives and discharges HPB and its directors, officers, agents, servants, employees and any person acting pursuant to the authority of HPB (collectively the “Released Parties”) from, and covenant not to sue the Released Parties or any of them for, any and all liability, claims, demands, actions and causes of action howsoever arising out of or in relation to an loss, damage or for the enforcement of any personal or proprietary right he/she may have in connection with the Image Recording or the Promotion Materials. HPB may require participants to sign separate written releases.

f)
|
HPB shall have the right to disclose and publish the name and any other particulars of participant(s) for Publicity Purposes and participant(s) shall consent, co-operate and participate fully in the activities organised by HPB for such purposes, without any payment, fee or compensation whatsoever.
|

6.
|
General terms and conditions
a)
|
HPB reserves the rights to amend the TnCs without prior notice. A participant’s continued participant in the Art of Taste or continued engagement with the Art of Taste through their artwork signifies their unqualified acceptance to the amended TnCs.
|
b)
|
HPB reserves the right at its sole discretion, to suspend, postpone or terminate the Art of Taste or shorten or extend the duration of the Art of Taste and/or amend, modify, delete, supplement, replace or revise the TnCs, without any liability or prior notification to any person, including but not limited to any participant.
|
c)
|
HPB shall not be liable for any failure to perform, or delay in performance, due to circumstances beyond its reasonable control, including but not limited to, acts of God, natural disasters, pandemics, strikes, government actions, or other events outside HPB's reasonable control.
|
d)
|
The participant shall indemnify and hold HPB, its officers, employees, agents, and affiliates harmless from and against any claims, losses, damages, liabilities, and expenses (including legal fees) arising from or related to the participant's breach of these TnCs or any unlawful or negligent acts during participation in the Art of Taste.
|
e)
|
In all circumstances, HPB’s decisions shall be final, binding and conclusive on all matters relating to the Art of Taste, and no further correspondence shall be entertained. Participants agree and undertake to be bound by the aforesaid decisions.
|
f)
|
The TnCs shall be governed by the laws of Singapore. The TnCs shall constitute the entire understanding and agreement between the HPB and the participants. The TnCs are not intended to confer rights on any third-party cap, whether pursuant to the Contracts (Rights of Third Parties) Act 2001 or otherwise, and no third party shall have any right to enforce any provision of the TnCs. If any dispute arises between the participant and HPB, both parties shall first engage in good faith discussions to resolve the matter amicably. If the dispute is not resolved within a reasonable time, it shall be referred to the Singapore Mediation Centre for mediation under its rules. Participation in mediation is a prerequisite to pursuing any other form of dispute resolution, including litigation.

g)
|
If any term or provision of the TnCs is held to be illegal or unenforceable, such term or provision shall be deemed to be deleted from the TnCs and the validity or enforceability of the remainder of the TnCs shall remain in full force and effect. HPB’s failure to enforce at any time the provisions of the TnCs or any rights in respect thereto shall in no way be considered to be a waiver of such provisions, rights, or elections or in any way affect the validity of the TnCs.

h)
|
In the event of any inconsistency between the TnCs and any brochure, marketing or promotional material relating to the Art of Taste, the TnCs shall prevail.
|
i)
|
All information with regards to or in connected with the Art of Taste is correct at time of publishing and subject to change without notice or liability to participants.
